Commentary by Attorney Michael Grossman
This crash raises critical questions about the actions of the semi-truck driver and whether there was an opportunity to avoid colliding with the sedan. When a large truck strikes a smaller vehicle, the consequences are often severe, as seen here.
One key focus is whether the semi-truck driver was traveling at a safe speed for the conditions and whether they had enough time to see the sedan entering the intersection and respond appropriately. Trucks require significantly more distance to stop than passenger vehicles, making speed and attentiveness crucial. Evidence such as the truck’s engine control module (ECM) data, dashcam footage and witness statements will be central to determining whether the truck driver took appropriate action, such as braking or attempting to steer away from the sedan.
Another important factor is whether the truck driver was fully alert. Distractions, fatigue or other impairments can significantly reduce a driver’s ability to respond in time to avoid a collision. Investigators will need to review the driver’s logbooks to confirm compliance with hours-of-service regulations and look into whether any in-cab distractions, like cell phone use, may have played a role.
The mechanical condition of the semi-truck also warrants examination. Was the truck’s braking system functioning properly? Did the vehicle have any maintenance issues that could have compromised its ability to avoid the crash? A thorough inspection of the truck will help rule out mechanical failure as a contributing factor.
Intersections can present challenges for all drivers, particularly in rural areas. However, commercial drivers are held to a higher standard of care due to the size and weight of their vehicles. The responsibility to remain vigilant and operate with caution lies heavily on the truck driver, especially in areas with intersecting traffic.
For the families affected by this crash, understanding whether the truck driver’s actions — or lack thereof — contributed to the collision is essential. A full investigation will help ensure accountability and may highlight ways to improve safety for others using similar intersections in the future.
