Commentary by Attorney Michael Grossman
While the cause of the accident isn't clear right now, one thing is true between just about any fatal work accident in Texas. Simply put, Texas has the most complex work fatality law of any other state in the country. Employers are not required to subscribe to the workers' comp system, so there isn't always a guaranteed path to get a victim's loved ones the benefits they need.
This often leads to situations where families trust that OSHA or their loved ones employer are working to help them only to find out no one was looking out for their best interests, rather their own. That's why it's important not to simply wait around on the authorities to get answers when there may be significant legal hurdles they alone aren't equipped to help families overcome.
