Commentary by Attorney Michael Grossman
People fend to think an accident reportedly involving alcohol must be open-and-shut. After all, intoxicated driving is obviously reckless and warrants consequences. But many accidents like this involve another wrongdoer: a negligent alcohol provider. Bars, liquor stores, and other establishments can face consequences if they unlawfully over-serve someone who is obviously intoxicated. This can include criminal investigations, fines, suspended licenses, and liability for injuries resulting from the intoxication.
Unfortunately, this isn't an area of the law that gets a lot of attention. I've handled hundreds of cases against negligent alcohol providers. A lot of the time, authorities have already moved on because they charged the intoxicated driver and that was all they cared about. Maybe they've been more thorough here to find out if the intoxicated driver here may have been over-served. In my experience, though, that often requires more thorough independent investigations.
