Commentary by Attorney Michael Grossman
When people see situations like this, they may be quick to write the whole situation off as open-and-shut. In reality, there could still be more to this story than even authorities know. For instance, with intoxicated driving allegedly being a factor here, was the driver unlawfully over-served by a bar?
In Texas, alcohol providers can be responsible for contributing to serious accidents. If evidence shows they unlawfully over-served someone who was obviously intoxicated, and it leads to people being hurt or killed, those establishments can face consequences just as intoxicated drivers do.
In my experience, though, authorities tend to move on once they have someone to blame. I can't count how many times we found a negligent alcohol provider and held them accountable when the authorities were more than content solely holding an intoxicated driver accountable. Maybe authorities are being more thorough here to get the whole story, but it's something to keep in mind as investigations continue.
