Commentary by Attorney Michael Grossman
Single-vehicle wrecks make up a large portion of the accidents I get calls about. Simply put, people want to know that their side of the story is going to be told fairly, and they aren't always sure authorities are going to do that. Authorities certainly can conduct good, thorough investigations, but it can help to follow up with them and ask key questions early on.
One of the first things to ask is whether investigators had the proper time and resources to fully examine the scene. When departments are stretched thin or don’t have access to the right equipment, it’s easy for critical details—like tire marks, vehicle position, or road conditions—to go undocumented. Without those, it’s much harder to understand exactly what caused the vehicle to lose control.
It’s also worth asking whether a vehicle defect could have played a role. Problems with steering, brakes, or even a sudden tire failure can cause a vehicle to overturn unexpectedly. These issues usually require a close inspection of the vehicle, and if no one takes steps to do that early, the opportunity to identify a defect may be lost.
Finally, was the vehicle’s electronic crash data preserved? Most modern vehicles record valuable pre-crash information like speed, braking, and steering input. That data, along with phone records or nearby camera footage if available, can help fill in the blanks—but only if it’s secured quickly.
If authorities can't provide satisfactory answers to these questions, it gives people an opportunity to seek out independent investigations. That way, they can ensure that the evidence is able to speak for itself.
