Commentary by Attorney Michael Grossman
Anytime charges for driving while intoxicated come up, people tend to see them as a sign that a crash is open-and-shut. But a lot of the time, DWI charges are just part of the larger story. If, for example, authorities determined that alcohol caused the crash, where did the alcohol come from?
In Texas, bars and other establishments can also be responsible for a crash if they unlawfully over-served someone, and that person's intoxication led to people getting hurt. Too often, though, this goes completely overlooked. I can't count how many times a family called us about an intoxicated driver accident, and we found out authorities never bothered looking into the possibility the driver had been over-served. Hopefully authorities here have been more thorough.
