Initial details in an OSHA accident investigation summary say that the accident took place off Ike Avenue and 21st Street in southeast Monahans.

According to authorities, 31-year-old Arturo Galvadon Sanchez was working to change out tires on a John Deere tractor. It appears the jack holding up the tractor failed, and the tractor landed on Galvadon Sanchez. As a result, Galvadon Sanchez was killed.

Commentary by Attorney Michael Grossman
There are two key things that stand out to me here. One is the simple fact that any fatal work accident in Texas can present significant challenges. Texas has the most complex work fatality laws of any other state in the country. there isn't always a guaranteed path for a worker's loved ones to receive benefits following an accident. That means families may need experienced and well-equipped allies who are able to navigate that legal maze.
Secondly, people don't often give much attention to a jack failing. They often assume it was used wrong or wasn't in good working condition. However, it's also worth considering the possibility the equipment had a defect. Likely or not, there are times when equipment is used properly, but it fails anyway due to manufacturing mistakes the victim had no control over. If nothing else, did investigators examine the jack to confirm or rule out this possibility?
Ultimately, OSHA has their own priorities. Sometimes, those priorities align with the needs to a worker's family. A lot of the time, though, families need independent investigators filling in the gaps to ensure they have the whole story. It remains to be seen what steps would have to be taken here to ensure nothing important slips through the cracks.
