Commentary by Attorney Michael Grossman
In any crash where a vehicle leaves the roadway, results in the loss of life, and leaves another occupant seriously injured, there are critical questions that must be answered to understand what truly happened. Surface details can only tell part of the story. A meaningful investigation must go deeper—beginning with three foundational areas of inquiry that apply to every serious incident.
First, has the crash been thoroughly investigated by the authorities? In situations where a vehicle departs the roadway with no immediate explanation, investigators must carefully reconstruct the sequence of events. That includes examining road conditions, possible visual obstructions, curve design, surface irregularities, and any contributing environmental factors. When someone is ejected from the vehicle, as was the case here, questions about seatbelt usage and the vehicle’s safety system performance become especially important. A detailed review of physical evidence at the scene is the only way to begin making sense of an otherwise unclear incident.
Second, has anyone explored the possibility of a mechanical or design defect playing a role? Crashes attributed to “loss of control” often involve more than just human error. Failures in systems like power steering, braking, or electronic stability control can all lead to sudden deviations from the driver’s intended path. Additionally, if the vehicle's structural or restraint systems didn’t perform as expected—especially given the severity of the outcomes—that raises important concerns about vehicle design and safety engineering. These are technical questions that require expert attention, but they’re crucial to determining whether something went wrong inside the vehicle itself.
Third, has all relevant electronic data from the vehicle been collected? Most modern vehicles are equipped with electronic control modules (ECMs), which store essential crash-related information such as speed, throttle position, brake usage, and steering inputs. This data provides critical insight into how the vehicle was being operated in the final seconds before the crash and whether it responded to driver input as expected. In addition, cell phone usage data or surveillance footage from the surrounding area could help complete the timeline and offer additional context.
When a crash results in fatal and life-altering injuries—and especially when the cause remains unclear—the investigation must go well beyond surface-level reporting. By focusing on a complete analysis of the scene, examining vehicle performance, and securing electronic evidence, we move closer to a full understanding of what occurred. Those involved—and those left seeking answers—deserve nothing less.
