Commentary
Believe it or not, I've received many calls about incidents similar to this one. People often want to know if property owners can be responsible for these kinds of incidents. The answer is generally that it depends on if the property owners made reasonable steps to keep patrons safe.
For example, if this was just a sudden, isolated, unpredictable episode of violence, there's not really much an establishment can do to prevent people from getting hurt. However, if a local establishment sees numerous violent incidents, that danger may be deemed predictable. Property owners then have a duty to improve safety. This can include hiring extra security guards, installing cameras, improving lighting outside the establishment, or even warning customers of the potential risks so they can decide if they want to accept that risk.
If there is a reasonable expectation that people may get hurt, property owners have a basic legal responsibility to reduce the chance of harm. That's why it's important after incidents like this to be more thorough than just focusing on the individuals directly involved in the violence. Those individuals are already likely to answer for the mistakes they made. If anyone else made mistakes that contributed to the incident, the victims and families involved deserve to know about it.
