Commentary by Attorney Michael Grossman
Whenever there's an alleged drunk driver involved in an accident, people are quick to assume everything is open-and-shut. As obviously wrong as drunk driving is, though, there could be a lot more to the story. Particularly, it's important to find out if a negligent alcohol provider contributed to the accident. Let me explain.
Texas law allows alcohol providers—like bars and restaurants—to be held accountable when they serve someone who is already obviously intoxicated. Doing so creates a serious hazard for people out on the roads, so there are paths for ensuring those alcohol providers face appropriate consequences just as drunk drivers do.
It’s worth asking, then: Where did the driver get their alcohol? Was it at a licensed establishment? And if so, did staff ignore obvious signs of intoxication and continue to serve them anyway? These are the kinds of questions that often go unanswered when authorities authorities feel they have a clear "bad guy." However, getting these answers can be crucial both to get victims and families a proper conclusion and to help make our communities safer.
