Commentary by Attorney Michael Grossman
Even if the allegations here are true, and this all happened because a truck driver made an unsafe turn, this isn't likely to be some open-and-shut situation as people may assume. The reason I say this is that commercial truck wrecks often involve more than just an individual reckless truck driver. Investigations must also consider the potential role the truck driver's employer played in the accident.
I've handled hundreds of commercial vehicle accident cases. In my experience, trucking companies sometimes create the exact conditions that make dangerous decisions like making an unsafe turn inevitable. For example, when companies set aggressive delivery schedules, they put pressure on drivers to rush, even if that means taking risks they otherwise wouldn’t. Add in the possibility of poor hiring decisions or inadequate training, and it becomes clear how a driver could end up making a dangerous maneuver like this.
That's why investigations into crashes like this one need to involve more than just a typical crash reconstruction. It’s critical to dig into the truck driver's cell phone records, any available dash camera footage, dispatch communications, electronic hours of service logs, hiring and training records, and the truck’s electronic data. This can help investigators dig beyond surface-level problems and potentially get to the heart of why this crash really happened. If it was just one reckless driver's mistake, they can be held accountable. If there's a whole company putting lives at risk, they can be held accountable, as well.
