Commentary by Attorney Michael Grossman
While authorities weren't so specific in their statements, it seems very possible the truck involved here failed to yield to the motorcyclist. There don't appear to be any lights or stop signs on this stretch of Addicks Satsuma, so an oncoming truck would have to yield to oncoming traffic. Especially considering this was in daylight hours, I can't help but wonder if this is an all too familiar tale of a driver not keeping a proper lookout for motorcyclists.
Throughout my career, I've seen too many examples of people being entirely unaware of motorcyclists. People get too comfortable behind the wheel, and they forget that not everyone is on four wheels. When that lapse in judgment occurs, innocent people pay the price. Obviously, if that's what led to this accident, it would likely call for accountability.
That's why it bothers me that the vehicle making the turn was apparently a box truck. That suggests a commercial vehicle, and commercial drivers are held to a higher standard than typical drivers. Not only that, but their behavior is often a product of their employer's behavior and standard of safety. With that in mind, was this just an isolated mistake, or rather the result of a pattern of preventable behavior?
Was this driver not properly trained? Were they on their phone? Were they pressured to meet an unreasonable deadline? Did they have a history of negligent behavior that went ignored? Were they on the phone with an overbearing supervisor? These are the kinds of questions a proper accident reconstruction should include. So on top of simply finding out what happened here, it's important the victim's loved ones know why this happened and who is going to take responsibility.
