Commentary by Attorney Michael Grossman
With these types of trucks, it's important that investigators are more thorough than what people may generally envision for a crash investigation. Obviously, looking into things like fatigue, intoxication, distraction, and speeding are important. However, if this happened to be a rental truck or one used for commercial purposes, maintenance issues and vehicle condition also are crucial to consider.
Say, for example, someone goes and rents a truck for some personal business, and the rental company gives them a truck with bald tires. If that contributes to an accident, the rental company may be responsible for that. Or, if the driver was working for a company that put off routine maintenance work to help their bottom line, that's unacceptable behavior which needs to be addressed before more people get hurt.
Those are just examples, to be clear, of why a careful and thorough investigation is so important here. Maybe authorities have taken steps to preserve the truck and make sure it's analyzed properly, but it sometimes takes outside pressure from the victims and families involved to make sure that happens.
