Commentary by Attorney Michael Grossman
When a single vehicle hits a fixed object with enough force to breach the cabin, that’s not just an impact—it’s a mechanical failure, a driver action, or something unexpected that caused a major deviation from the road. Getting to the root of it means looking well beyond the surface.
1. Did the authorities thoroughly investigate the crash?
With no known explanation for why the vehicle left its path, the investigation should focus squarely on what led up to the impact. Did the vehicle veer suddenly? Were there signs of braking or attempted correction? These details can only be found through careful scene analysis—mapping tire marks, examining guardrail damage, and checking for signs of steering input or vehicle drift. Not all investigations include this level of scrutiny, especially in single-vehicle crashes, but that’s where the real answers often lie.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical issues can cause sudden, unplanned movements—loss of steering control, brake failure, or even problems with throttle response. A guardrail strike severe enough to penetrate the vehicle deserves inspection into whether something malfunctioned in the moments before impact. This kind of failure doesn’t always leave obvious clues, especially once the vehicle has been towed or damaged further during rescue. That’s why a detailed inspection by a qualified technician is essential—not optional.
3. Has all the electronic data relating to the crash been collected?
When the driver’s condition prevents immediate questioning, data from the vehicle becomes the most reliable source of insight. Speed, braking, throttle input, and steering angle—all of it could tell a clearer story of how the vehicle behaved and how the driver responded. GPS data and mobile device usage could also offer useful clues. Without this information, officials are left guessing—and guessing is no way to reach a solid conclusion.
Every crash deserves attention, but the ones that make no immediate sense deserve it most. If the investigation stops at “unknown reasons,” critical truths about what happened and why may never come to light.
Takeaways:
- Single-vehicle crashes must be investigated thoroughly, especially when the cause isn’t obvious.
- Hidden mechanical failures can lead to serious outcomes and require expert inspection.
- Electronic vehicle and phone data may be the only way to understand what truly occurred.
