Commentary by Attorney Michael Grossman
When a vehicle carrying two young occupants rolls without any clear external cause, the easy answer is often chalked up to driver inexperience or error. But that’s rarely the full story—and it's why serious questions need to be asked before drawing conclusions.
1. Did the authorities thoroughly investigate the crash?
A rollover without another vehicle involved should trigger a detailed scene reconstruction. Investigators should analyze the vehicle’s trajectory, tire marks, and whether there were any attempts to brake or steer before the vehicle rolled. These steps are critical to determine if the driver lost control or if something unexpected occurred. If the investigation stops at the surface, important evidence could be missed.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Single-vehicle rollovers can stem from issues like tire blowouts, steering malfunctions, or suspension failures—problems that aren’t always obvious at a glance. A full mechanical inspection of the vehicle should be conducted to determine if any equipment failure contributed to the crash. Without it, we’re left to assume the vehicle was in proper working order, which may not be true.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles log a wealth of data leading up to a crash—speed, steering input, braking, and any alerts triggered. This data can help explain whether the driver took corrective action, or if the vehicle responded as it should have. It's also the only reliable way to piece together events when those involved can’t give their version. That information should be secured as early as possible before it’s lost or overwritten.
Crashes like this deserve more than quick explanations. They require careful work to uncover what really happened—and why.
Plain-language takeaways:
- Single-vehicle rollovers need full scene analysis to understand what caused them.
- Mechanical problems may be involved and should be checked thoroughly.
- Digital vehicle data can show whether the driver tried to stay in control.
