Commentary by Attorney Michael Grossman
When a car leaves the roadway and hits a fixed object, it’s easy to assume the cause is straightforward. But serious crashes like this rarely have just one explanation, and understanding what truly happened takes more than a quick look at the scene.
The first question is whether investigators will conduct a detailed reconstruction of the crash. A high-speed loss of control can involve many factors—driver actions, vehicle handling, and roadway conditions leading up to the moment of impact. Careful analysis of tire marks, vehicle movement, and pre-crash behavior is essential to building an accurate picture. Unfortunately, these deeper steps aren’t always part of a standard investigation, meaning vital clues could be missed.
The vehicle itself deserves a close inspection as well. A sudden inability to maintain control can point to potential defects—like steering or suspension failures, brake issues, or even a stuck throttle. These problems often don’t leave obvious signs visible to the naked eye, and only a thorough mechanical evaluation can rule them out.
Electronic data can also play an important role in answering questions. Many modern cars store information on speed, braking, and steering input in the seconds before a crash. Nearby cameras or phone records could add additional clarity. If investigators don’t secure this data early, it can be lost, leaving only assumptions about what led up to the collision.
Crashes like this deserve careful attention to every possible cause. Without a complete investigation, it’s impossible to know whether the outcome was the result of human error alone or something more complex.
Key Takeaways:
- Serious crashes need thorough reconstruction to determine how and why control was lost.
- Mechanical failures can contribute to a loss of control but are often overlooked without expert inspection.
- Electronic data from the vehicle or surrounding area can provide key answers if gathered promptly.
