Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured bicyclist is receiving appropriate care and that the investigation is focused on determining the full set of circumstances that led to the incident. A collision between a car and a bicycle, particularly one occurring at night in a residential area, warrants careful scrutiny. To fully understand what happened on Orinda Drive, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? At 9:15 p.m., lighting and visibility conditions are crucial. Were the street lights functional and sufficient to illuminate the area where the bicycle was crossing? Was the intersection marked with stop signs, crosswalks or other traffic control devices? Were both parties operating within their respective rights-of-way? A full scene analysis should account for sightlines, lighting, signage and the position of both the vehicle and bicycle at the time of impact to determine whether the collision could have been avoided.
Second, has anyone considered whether a vehicle defect may have contributed to the crash? The 2022 Dodge Challenger should be evaluated for mechanical or safety system issues, particularly related to headlights, brakes or driver-assistance features such as forward collision warning or pedestrian detection. If the vehicle failed to properly illuminate the intersection or if there was a malfunction that limited the driver’s ability to respond, that would be a significant factor. Likewise, if the cyclist had lights or reflectors on the bicycle, those details should be part of the investigation.
Finally, has all the electronic and digital data related to the crash been collected? The Dodge Challenger is equipped with an engine control module capable of capturing pre-crash data such as vehicle speed, throttle input and braking activity. This data can help determine whether the driver had time to react and whether evasive action was taken. Additionally, GPS data, dashcam footage or surveillance from nearby homes could provide further insight into the bicyclist’s position and movement leading up to the crash. Preserving this data early is essential to ensure accuracy.
Crashes involving bicyclists deserve detailed, impartial investigation. A young man was seriously injured, and while assumptions might be made based on visibility or location, those assumptions are not a substitute for facts. By asking the right questions and gathering the right evidence, we can determine whether the collision was truly unavoidable, or if something could have been done differently to prevent it. That’s a question worth answering not only for those involved, but for the broader safety of everyone who shares the road.
