Commentary by Attorney Michael Grossman
I have concerns anytime I see a crash involving a teen driver. Frankly, authorities are sometimes quick to jump to conclusions. A lot of people are already biased against younger drivers as is, so that only raises red flags that the investigations may not be as thorough as they need to be. That's one of the reasons it can be vital to ask questions of the authorities early on and gauge their responses.
One of the first questions to ask is whether investigators had the time, training, and resources to conduct a complete investigation. Single-vehicle crashes in the early morning hours, like this one, can be challenging to reconstruct—especially if key evidence like tire marks or debris placement isn’t documented right away. Not every department is equipped for detailed crash analysis, and when a young driver is involved, there’s a risk that assumptions can replace careful investigation.
It’s also important to consider whether a vehicle defect could have played a role. The Volkswagen GTI is a high-performance vehicle, and a sudden mechanical issue—like a tire failure or steering problem—could easily lead to a crash. But without a proper forensic inspection of the vehicle, these possibilities often go unexplored. Preserving the vehicle is essential to answering those questions.
Finally, has any electronic data been collected? Vehicles like the GTI typically store crash-related information in their onboard systems, including speed, steering input, and braking. Paired with cell phone data or any available surveillance footage, that kind of evidence can offer vital context. But if it’s not preserved quickly, it may be gone before anyone has a chance to look at it.
At the end of the day, the victim isn't here to speak for themselves. That makes clear evidence even more important. If authorities can address these questions adequately, it can reassure the family that they're going to get the answers they deserve. But if their responses leave doubts and questions, then it gives families a chance to seek out independent investigations that may be able to fill in the gaps. Either way, they need to know they're going to get the full story.
