Commentary by Attorney Michael Grossman
Crashes at busy intersections often leave more questions than answers. In the wake of sudden, violent impacts, it’s easy to accept the surface-level story. But what truly matters—especially when lives are upended—is making sure someone takes the time to dig deeper.
1. Did the authorities thoroughly investigate the crash?
It’s unclear whether investigators took the time to conduct a full forensic analysis of this crash. When one vehicle blows through an intersection, the immediate conclusion often leans toward driver error. But that can be a shortcut that skips over crucial details. Did anyone reconstruct the crash using laser mapping? Were there interviews with witnesses or checks into the drivers’ behavior leading up to the crash? Not all investigators have the same training, and sometimes critical evidence can go unnoticed if there’s a rush to clear the scene.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
It’s worth asking whether the Volkswagen’s brakes or sensors were in working order. A failure to stop could easily be mechanical, especially if the vehicle showed no signs of braking or attempted correction. Without a thorough inspection of the braking system, electronic stability control, and accelerator function, it’s impossible to rule out a defect. These issues don’t always leave obvious clues, and without checking, they’re too often missed.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles hold a treasure trove of information that can clarify exactly what happened. The Atlas and Pathfinder likely recorded whether the driver hit the brakes, how fast the vehicles were going, and even whether hands were on the wheel. Paired with any nearby traffic cameras or GPS tracking data, this information could confirm or challenge assumptions about what led to the collision. But that data needs to be retrieved quickly—before it’s lost or overwritten.
We can’t just assume the simplest explanation is the correct one. When people get hurt in a crash like this, the only way to understand what really happened is to ask better questions and take the time to answer them thoroughly.
Key Takeaways:
- Surface-level investigations may overlook critical crash evidence.
- Vehicle defects can cause intersection crashes, even if they’re not obvious.
- Electronic data from cars and traffic cameras can provide crucial insight.
