Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver receives the care he needs and that those close to him get the answers they deserve. While it may seem like a straightforward case of a vehicle losing control and overturning, my experience has shown that these types of crashes often involve contributing factors that aren’t immediately obvious. Before drawing any conclusions, it’s essential to ask three key questions to ensure a full and thorough investigation.
The first question is whether authorities conducted a comprehensive investigation. Law enforcement typically documents the scene and assesses visible evidence, but the depth of an investigation can vary widely. In a single-vehicle crash where the vehicle left the road and overturned, investigators should examine whether road conditions, poor signage, or unexpected obstacles played a role. They should also consider whether the layout or design of the road itself could have contributed to the vehicle's path leading into the ditch.
The second question—one that is often overlooked—is whether a mechanical defect contributed to the crash. The Toyota Tacoma, like any vehicle, relies on properly functioning brakes, steering components, and stability control systems. A failure in any of these could lead to a sudden loss of control. Additionally, tire issues or suspension failures can cause or worsen an overturn event. Determining whether a mechanical defect played a role requires a forensic inspection of the vehicle, and if the truck is not preserved, that opportunity may be lost.
The third question is whether all available electronic data has been collected. Most modern vehicles are equipped with an electronic control module (ECM), which records key data such as speed, braking, and steering inputs just before a crash. This data can be crucial for understanding exactly what happened. Additionally, any available dashcam footage, nearby surveillance video, or even information from the driver’s cell phone could offer additional context. These forms of evidence are often time-sensitive and should be preserved quickly.
At the end of the day, answering these three questions isn’t just about determining the cause of the crash—it’s about ensuring the injured driver and their family have access to the full truth. When a serious crash occurs, especially one involving injuries and unanswered questions, the community has a responsibility to ensure that every possible factor is explored before reaching any conclusions.
