Commentary
When I read about a crash like the one in Gun Barrel City, my first thought is that those affected deserve clear answers about what happened. A vehicle swerving to avoid another car and striking a pedestrian may seem like an unfortunate chain of events, but in my experience, these incidents are often more complex than they first appear. That’s why there are three critical questions that should be asked in any crash investigation.
First, did the authorities conduct a thorough investigation? Pedestrian crashes present unique challenges, especially at night. Was the roadway well-lit? Were there sidewalks or shoulders available for pedestrians, or was the person forced to walk dangerously close to traffic? Additionally, identifying the actions of the other vehicle is crucial: did it make an unsafe lane change, stop abruptly or fail to yield the right of way? Without a full accident reconstruction, important factors could go overlooked.
Second, has anyone looked into whether a vehicle defect played a role? The Dodge Charger involved in the crash was several years old, meaning mechanical failure cannot be ruled out. Sudden brake failure, steering malfunctions or stability control issues could have affected the driver’s ability to maintain control while swerving. Additionally, modern vehicles rely on electronic safety systems that should help prevent accidents. Were these systems functioning properly? If the vehicle is repaired or scrapped before being examined, valuable evidence of a defect could be lost.
Lastly, has all electronic data related to the crash been collected? The Charger likely contains an engine control module that stores key information such as speed, braking force and steering input in the moments leading up to the crash. This data could confirm whether the driver had enough time to react or if they attempted to slow down before impact. Additionally, surveillance footage from nearby businesses, traffic cameras or dashcams could provide critical evidence about both the pedestrian’s movements and the actions of the other vehicle. If authorities haven’t gathered this information, an independent investigation may still be able to do so.
At the end of the day, every serious crash deserves a complete and thorough investigation. Pedestrian crashes can be particularly complex, and those affected deserve to know whether every factor was properly considered. Without answering these three key questions, it’s impossible to say with certainty what led to the crash, and that’s not a conclusion anyone should have to accept.
