Commentary by Attorney Michael Grossman
When reports describe a crash simply as “two vehicles collided at the intersection,” that doesn’t come close to explaining how or why it happened. For the injured, it’s not enough to know the outcome—they need to know the details behind it.
Was the crash investigated thoroughly?
Intersection collisions often hinge on small details like timing, speed, and lane position. A complete investigation would involve roadway mapping, measuring skid marks, and reviewing how each vehicle struck the other. Without that work, the explanation may be more assumption than fact.
Could a vehicle defect have contributed?
It’s easy to place the blame on one driver, but a brake failure, steering issue, or even a blown tire could have caused one vehicle to end up in the wrong spot at the wrong time. On top of that, failures in airbags or seatbelts can explain why one driver suffered serious injuries while another did not.
Has electronic evidence been preserved?
The Toyota and Ford both likely carry Engine Control Modules (ECMs) that can show speed, throttle, and braking input in the seconds before the collision. In a busy area near the freeway, camera footage may also exist to help clarify what actually happened. This type of evidence is time-sensitive and should be secured quickly.
A police report that ends with “the vehicles collided” may summarize the crash, but it doesn’t provide real answers. Those come from digging deeper into every possible source of evidence.
Takeaways:
- Intersection crashes require more than surface-level explanations.
- Vehicle or safety system failures could have affected both cause and injury severity.
- ECM data, cameras, and cellphone records are key to a complete investigation.
