Commentary by Attorney Michael Grossman
In the aftermath of a serious wreck, the visible damage often tells only part of the story. Families and communities may find themselves grasping for answers, not just about what happened—but why. That’s where a proper investigation matters most.
1. Did the authorities thoroughly investigate the crash?
When two vehicles collide at an intersection, especially with lives lost and serious injuries, it's crucial to determine how the events unfolded moment by moment. That can't happen without a detailed investigation. Laser mapping the scene, reconstructing vehicle paths, and interviewing witnesses can reveal whether either driver acted improperly—or if something else was at play. The challenge is that not every department has the same tools or training. In rural areas, it’s not uncommon for the initial investigation to stop short of a full forensic reconstruction. Without that depth, conclusions can be premature or incomplete.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
If a truck failed to stop as reported, mechanical failure can't be ruled out without a full inspection. Brake issues, sensor malfunctions, or even software errors in newer vehicles can all lead to a dangerous loss of control. It’s not enough to rely on assumptions based on damage patterns. A faulty component might not leave an obvious trace without a trained mechanic digging into the vehicle. These inspections often fall by the wayside unless someone pushes for them.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles are packed with data that can show exactly what happened in the seconds before impact—speed, brake use, throttle position, and more. Phones and GPS units could also reveal distractions or travel behavior leading up to the wreck. But accessing this information requires intention. If investigators didn’t recover or review this digital evidence, they may have missed the clearest clues of all.
Looking past the crash itself and into the factors that shaped it is where real answers lie. Every wreck has a story, but unless someone demands the full truth, that story might never be told right.
Takeaways:
- A full crash reconstruction may be needed to truly understand what happened.
- Mechanical issues can’t be ruled out without a hands-on vehicle inspection.
- Vehicle and phone data often hold key evidence, but must be actively retrieved.
