Commentary by Attorney Michael Grossman
When a single-vehicle crash ends in a fatality and the vehicle is found overturned, it raises important questions that go far beyond the visible damage. Just because no other vehicles were involved doesn’t mean the incident was straightforward—or that all possible causes have been accounted for.
1. Did the authorities thoroughly investigate the crash?
A fatal crash with an overturned vehicle should prompt a detailed review of the scene. That means examining the vehicle’s path, analyzing skid marks, and determining how and where the truck left its intended direction. Did the driver attempt to correct? Were there signs of sudden steering or braking? Unless trained investigators reconstruct those moments with precision tools, much of what happened may never be understood.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a truck flips unexpectedly, the possibility of a mechanical failure has to be explored. A sudden issue with steering, braking, or even a structural fault in the suspension could cause a driver to lose control without warning. If no inspection is conducted—or if the review is only visual—critical problems could go unnoticed. A full mechanical evaluation is necessary to rule out deeper causes.
3. Has all the electronic data relating to the crash been collected?
Even in single-vehicle crashes, onboard vehicle systems can offer key insights. Speed, brake application, and steering inputs are often stored for several seconds before a crash. This data could show whether the driver tried to regain control or if something happened too quickly to respond. If there’s no effort to retrieve that information, the opportunity to learn from it may be lost for good.
Just because a crash involved only one vehicle doesn’t mean the investigation should be limited. The right questions—and the right tools—are essential to uncovering what really happened.
Takeaways:
- Fatal single-vehicle crashes should be investigated with full scene reconstruction.
- Mechanical failures in control systems must be ruled out through detailed inspection.
- Vehicle data can show whether the driver reacted—or had no chance to.
