Commentary by Attorney Michael Grossman
When a vehicle rolls over on the interstate and someone loses their life, the most important questions often have nothing to do with how the crash ended—and everything to do with what led up to it. Without a clear cause or details on what happened beforehand, it's critical to ask what might have gone overlooked.
1. Did the authorities thoroughly investigate the crash?
In a rollover with no clear explanation, scene investigation needs to go beyond the basics. That means evaluating whether the vehicle left any evidence of overcorrection, checking for skid marks or debris paths, and analyzing whether the rollover happened as a result of a sudden maneuver or something more gradual. If these details weren’t mapped and recorded early on, valuable insight into what triggered the crash may already be lost.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a vehicle flips unexpectedly—especially on a highway with no other known vehicles involved—it’s important to consider whether a mechanical failure might have occurred. Tire blowouts, suspension damage, or a steering malfunction could all cause the driver to lose control with little warning. The severity of the crash also raises questions about whether the rollover protection systems functioned as designed. Without a full mechanical inspection, key contributing factors may be missed.
3. Has all the electronic data relating to the crash been collected?
Vehicle data systems often record vital information in the moments before a crash: steering angle, speed, throttle position, and braking behavior. This data can provide clarity on whether the driver attempted to correct or slow down—and whether the vehicle responded. Additionally, GPS and phone data might help establish whether there were distractions or other variables in play. If that information wasn’t collected early, there’s a good chance it won’t be recoverable later.
When a fatal crash ends in a rollover with no clear cause, the questions don’t stop—they just shift. And unless someone is asking the right ones, the full story behind the crash may never come to light.
Takeaways:
- Rollover crashes with no visible cause require in-depth reconstruction and vehicle path analysis.
- Mechanical systems like tires, suspension, or steering must be inspected for possible failure.
- Crash data from the vehicle can reveal driver input and vehicle performance in the moments before the crash.
