Commentary by Attorney Michael Grossman
When a motorcycle swerves to avoid an obstacle and overturns, the outcome often raises more questions than it answers. The real issue is whether investigators will look past the immediate explanation and examine all possible contributing factors.
Did the authorities thoroughly investigate the crash?
In a single-motorcycle crash, careful scene documentation is essential. Investigators should measure tire marks, determine where the swerve began, and map the motorcycle’s path until it came to rest. These details can help show whether the rider lost control due to the maneuver itself, road surface conditions, or something more sudden. The completeness of that work depends on whether the scene was reconstructed with precision.
Has anyone looked into the possibility that a vehicle defect caused the crash?
While swerving to avoid an animal may explain part of the event, a mechanical issue could have contributed. Problems with the brakes, steering, or tires can make it harder to recover control after a sharp maneuver. Without a full inspection of the Honda, the possibility of a defect playing a role remains open.
Has all the electronic data relating to the crash been collected?
Although motorcycles typically have less onboard data than passenger vehicles, some models capture information on speed and braking. In addition, GPS devices, helmet cameras, or nearby security footage could provide valuable context about the rider’s actions and vehicle behavior. Collecting that evidence quickly ensures it isn’t lost.
Finding the truth in a case like this requires combining scene evidence, a mechanical review of the motorcycle, and any available data to make sure no contributing factor is overlooked.
Takeaways:
- Detailed scene mapping can show whether the loss of control was sudden or gradual.
- Mechanical inspections may reveal failures that worsened the effects of the swerve.
- GPS, camera, or limited onboard data can provide insight into the rider’s final actions.
