Commentary by Attorney Michael Grossman
When young drivers are involved in high-speed crashes, especially those involving ejection, the focus tends to center on age and experience. But the real story often lies in the deeper questions—ones that are too often left unanswered.
1. Did the authorities thoroughly investigate the crash?
Any time a vehicle crosses a median and both occupants are ejected, the scene calls for a full-scale crash reconstruction. That means analyzing tire marks, vehicle angles, and pre-crash behavior—not just checking boxes. With young drivers involved, it’s also important to understand whether the vehicle was being handled responsibly in the moments before the crash. None of this insight comes without proper time, training, and a thorough approach at the scene.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Loss of control doesn’t always come down to inexperience. A mechanical issue like a steering failure, brake malfunction, or suspension defect could explain sudden instability. It’s also worth checking whether safety features like seat belt systems functioned properly, especially given that both occupants were ejected. These aren't answers you get from looking at the wreckage—they require a hands-on mechanical inspection.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles—especially those driven by younger people—are often newer models with built-in data recorders. These systems can confirm speed, braking, and steering actions leading up to the crash. If phones were in use, that data could help rule out distraction or reveal a timeline of events. Without this information, critical details about what really caused the loss of control could be lost.
Crashes involving teens should be investigated with the same level of scrutiny as any other serious incident. Only by asking the right questions can we truly understand what went wrong—and what could prevent it from happening again.
Takeaways:
- Median-crossing crashes need full reconstruction to understand how control was lost.
- Mechanical defects or safety system failures may have played a role.
- Car and phone data are essential in cases where cause isn’t immediately clear.
