Commentary by Attorney Michael Grossman
When young occupants are seriously hurt in a crash and the cause isn’t immediately clear, it’s a reminder that not every incident is as simple as it first appears. In situations like this, waiting for details isn’t enough—what matters is whether the right questions are being asked from the start.
Did the authorities thoroughly investigate the crash?
With no clear explanation yet, the thoroughness of the initial investigation becomes critical. Did officers reconstruct how the crash unfolded, using tools like scene measurements and trajectory mapping? Were there signs of erratic driving, sudden braking, or evasive action before the impact? Especially when serious injuries are involved, anything less than a full analysis could leave out key factors—something that happens all too often when investigators rely only on visible damage or brief statements.
Has anyone looked into the possibility that a vehicle defect caused the crash?
When a vehicle ends up in a crash without a known trigger, mechanical failure should always be on the table. Problems with steering systems, braking, or electronic safety features can all lead to sudden loss of control—especially if a driver was unable to react in time. Unless the vehicle has been carefully inspected, there’s no way to know whether a malfunction contributed to the outcome.
Has all the electronic data relating to the crash been collected?
Most vehicles today store a wealth of pre-crash data—speed, throttle input, brake application, and safety system engagement. That data can show exactly what happened in the seconds leading up to the crash and whether the vehicle was responding as expected. If phones, GPS, or vehicle recorders weren’t reviewed, then some of the most useful evidence might still be sitting unread.
When the facts of a crash aren’t clear, and serious injuries are involved, it’s not just about finding out what happened—it’s about making sure no possibility is left unexplored.
Key Takeaways:
- Crashes with unknown causes demand full scene reconstruction and behavioral analysis.
- A vehicle inspection is necessary to rule out mechanical failure as a contributing factor.
- Vehicle and device data may offer critical clues about how the crash occurred.
