Commentary by Attorney Michael Grossman
One thing that stands out here—and I wonder if anyone else caught it—is that only one person was supposedly injured here. Now, that isn't always unusual, depending on the exact events that occurred. However, it's something can occasionally point to defects in a victim's vehicle. For example, I had a case not that long ago where a victim's injuries weren't actually due to a crash. They were the result of a defective seatbelt. Had the seatbelt functioned properly, the victim likely would have been fine.
I bring this up because defects too often fly under the radar. Authorities sometimes become so focused looking into more common factors that they overlook less obvious ones. That's why independent accident reconstructionists often end up covering new ground, and they may reveal that authorities missed something. Perhaps that wouldn't be true here, but it's something to consider if authorities ever move on and consider this matter resolved before they actually have all the facts.
