Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver receives the care and answers she needs. While it may seem like a simple case of a vehicle losing control, my experience has shown that crashes like this often have more to them than meets the eye. Before drawing any conclusions, it's important to ask three key questions to ensure that every possible factor is considered.
The first question is whether authorities conducted a thorough investigation. Law enforcement officers typically document the scene, take witness statements, and assess visible evidence, but the level of detail in these investigations can vary. In single-vehicle crashes, it's common to assume that driver error was the cause, but road hazards—such as uneven pavement, debris, or poor lighting—could also contribute. Investigators should take a close look at the crash site to determine if external factors played a role.
The second question—one that is often overlooked—is whether a vehicle defect contributed to the crash. Mechanical failures, such as brake malfunctions, steering issues, or electronic stability control failures, could all cause a driver to lose control, especially at highway speeds. In addition, modern vehicles rely on advanced driver-assistance systems, and if any of these systems malfunction, it could lead to unintended acceleration or loss of control. However, identifying a defect requires a forensic examination of the vehicle, and if it is not preserved, key evidence could be lost before it can be properly analyzed.
The third question is whether all available electronic data has been collected. Most modern vehicles are equipped with an electronic control module (ECM), which records important data such as speed, braking, and steering input in the moments leading up to a crash. Additionally, nearby traffic cameras, dashcams, or even the driver’s phone data could provide further insight into what happened. This type of evidence is time-sensitive, and if it isn’t secured quickly, it may be lost or overwritten.
At the end of the day, answering these three questions isn’t just about understanding how this crash happened—it’s about ensuring that the injured driver and her family have access to the full truth. Serious crashes leave people searching for clarity, and the least we can do as a community is make sure that every possible explanation is explored before reaching any conclusions.
