Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver is receiving the medical care he needs and that investigators are doing a thorough job of piecing together the factors that led to the crash. A single-vehicle collision involving a guardrail strike in the early morning hours raises important questions that go beyond simply assuming operator error. To understand what happened on F.M. 105, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? A vehicle striking a guardrail around 12:35 a.m. suggests that lighting, visibility and roadway design may have played a role. Was the guardrail properly placed and maintained? Was the road well-lit and clearly marked, especially approaching the area near Interstate 10? Did the driver encounter any obstructions, sharp curves or elevation changes that might have made control more difficult? A proper crash scene analysis should consider these environmental factors to determine whether the road contributed to the incident.
Second, has anyone considered whether a vehicle defect could have played a role? The 2012 Ford Fusion should be inspected for mechanical failures, especially in the braking system, steering, suspension or tires. Any malfunction in these areas could have caused or contributed to the vehicle veering off course. Given the severity of the injury, it’s also worth determining whether the car’s safety systems — seatbelts, airbags and structural protections — functioned as intended during the crash. A forensic examination of the vehicle is essential to identify any such issues.
Finally, has all the electronic data related to the crash been collected? The Fusion is likely equipped with an engine control module that records valuable pre-crash data, such as speed, throttle position, brake input and steering movements. This information could clarify whether the driver attempted to take corrective action and how the vehicle responded. If GPS data, surveillance footage or phone usage records are available, these too could help reconstruct the events leading up to the crash. Preserving this data early is critical to ensure its accuracy and usefulness.
Crashes like this one may seem straightforward, but they often involve a combination of factors that require careful investigation. A young driver was seriously hurt, and the community deserves a clear, fact-based explanation of what happened. That can only be achieved by asking the right questions and securing the right evidence before it's lost.
