Commentary by Attorney Michael Grossman
In the wake of any serious crash, it's natural to want fast answers. But often, what truly matters takes longer to uncover. A moment of impact might last seconds, yet understanding why it happened — and who’s truly responsible — can take much more than a surface-level review.
Did the authorities thoroughly investigate the crash? When motorcycles and passenger vehicles collide, the dynamics can be complex. It’s worth asking whether investigators dug into that complexity or stuck to basics. Did they reconstruct the scene using laser tools? Map out where each vehicle was before and after the impact? Consider the speed and behavior of both drivers leading up to the crash? Not all officers receive the same level of training in crash reconstruction, so the quality of the review can vary. In a case involving such serious injury, a deeper dive is not just helpful; it’s essential.
Has anyone looked into the possibility that a vehicle defect caused the crash? Motorcycles depend on precision. A stuck throttle, brake failure or even a tire blowout can instantly change a rider’s fate. On the other side, modern SUVs come equipped with collision sensors and braking systems that don’t always perform as expected. If nobody inspected the Harley or the Ford in detail, there’s no way to rule out a mechanical failure that might have contributed. A clean-looking crash scene doesn't mean all the working parts were actually working.
Has all the electronic data relating to the crash been collected? Both vehicles likely hold key data, especially the Ford, which almost certainly has onboard systems tracking speed, braking and even steering inputs. That kind of information can either confirm or contradict what people recall about the moments before impact. Add in nearby traffic cameras or GPS history, and the story of what really happened can look very different. But someone has to ask for that data early before it’s lost or overwritten.
There’s always more to a crash than broken glass and bent metal. What matters most is whether the right questions are being asked, and answered, while the evidence still has a story to tell.
Key Takeaways:
- Not all crash investigations look past the surface.
- Mechanical problems can be invisible without a full inspection.
- Vehicle and GPS data can uncover the truth, if someone looks in time.
