Commentary
If the allegations here are true, then people may be quick to see this situation as open-and-shut. But just because a driver has been accused of something that's obviously wrong doesn't mean a situation is simple. I've handled hundreds of alcohol-related accident cases, and they're about as complex as a case can get. A significant reason for this is how often drunk driving accidents involve negligent alcohol providers who can also be responsible for contributing to the crash.
Put simply, alcohol providers in Texas who serve someone that is obviously intoxicated are doing so unlawfully. This can expose those establishments to potential criminal investigations, fines, suspended licenses, or liability for the injuries resulting from that intoxication. Not only do these possible avenues provide opportunities to hold those negligent alcohol providers accountable, it can also put those establishments on the straight-and-narrow before their actions get anyone else hurt.
So while there aren't enough details available here for me to draw any concrete conclusions, any mention of alcohol likely is a sign of a complex legal maze for the victims and families involved in an accident. Hopefully steps are being taken here to consider these potential hurdles so they can be navigated properly.
