Commentary by Attorney Michael Grossman
When serious collisions happen late at night, questions naturally follow; not just about what occurred in the moment, but about what might have led up to it and what happens next. It’s one thing to know there was a crash; it’s another to know whether everything that could be learned from it is actually being uncovered.
Did the authorities thoroughly investigate the crash? At this hour, traffic is lighter and visibility can be limited, but those factors alone don’t tell the full story. What's important is whether the investigating agency did more than collect basic information. Did they diagram the scene with precision tools? Were speed estimates calculated, and did officers assess driver behavior leading up to the collision? These steps are essential for understanding how and why vehicles came together. In some departments, crash teams receive advanced training in reconstruction techniques, but that’s not universal, so the depth of the investigation can vary depending on who’s assigned to the case.
Has anyone looked into the possibility that a vehicle defect caused the crash? It’s tempting to assume that driver error explains everything, but mechanical failures can play a role, especially in older vehicles like the ones involved here. A failing brake system, stuck accelerator or even faulty lighting could alter how a driver responds or whether they're even seen. Unless a trained inspector examines both cars with defects in mind, those issues can easily be missed or dismissed.
Has all the electronic data relating to the crash been collected? Modern cars often carry digital footprints that can clarify what happened seconds before impact. Things like steering input, brake pressure or throttle use might be stored in onboard modules. Paired with GPS data or nearby traffic cameras, these pieces can help reconstruct events with far more clarity than witness memory alone. If no one has pulled that data, critical facts could remain hidden.
When a crash causes serious harm, the surface story rarely tells enough. Digging into how it happened, and making sure no stone is left unturned, can shape both accountability and safety going forward.
Key Takeaways:
- Not all crash investigations dig deep; some lack advanced tools or training.
- Vehicle defects like brake or sensor failures can go unnoticed without inspection.
- Onboard vehicle data and cameras can reveal what really happened before a crash.
