Commentary by Attorney Michael Grossman
I have to wonder what progress authorities made in their investigations here. It's possible this all was more than a simple case of speeding or driver inattention. For instance, early morning wrecks like this are prime candidates for drunk driving. Despite what people may think, alcohol-related accidents are rarely straight-forward or open-and-shut.
Evidence could show that a local alcohol provider unlawfully over-served the at-fault driver. That could lead to legal responsibility both for the drunk driver and for the negligent alcohol provider who unlawfully over-served them. That's not something authorities can take care of overnight. In fact, my experience has shown me authorities are actually ineffective at holding negligent alcohol providers accountable, often overlooking them entirely.
Maybe authorities were more thorough here, and maybe they've been able to rule out alcohol. Whatever ultimately led to this wreck, it's up to those involved to decide if their satisfied with the kinds of answers they're getting from authorities or if they feel the accident needs a second look.
