Commentary by Attorney Michael Grossman
One factor that could have serious implications for this incident is who exactly the victim was. Were they working at the time, or were they a customer or visitor?
For the former, Texas happens to have the most complex work accident laws of any other state in the country. It can create a significant legal maze for victims and families that is best prepared for as early as possible.
To the latter, if the victim just happened to be on the property and not an employee of this location, then that could fall under premises liability law. This has its own set of complex rules that require a completely different legal approach. This, too, would make early preparation a crucial step.
Either way, getting the facts of what happened here may be important, but it's just one piece of the puzzle. Steps must also be taken to ensure those affected by the accident know what lies ahead for them so they can prepare accordingly.
