Commentary by Attorney Michael Grossman
When accidents like this happen, it’s easy for people to assume they are the result of a simple mistake or bad luck. However, based on my experience, accidents involving large trucks often have deeper, more complex causes that require thorough investigation.
In this case, understanding why the truck driver failed to yield the right of way is crucial. Factors like distractions, visibility issues, and even potential mechanical problems need to be explored. A thorough investigation will help ensure that all contributing elements are identified and addressed.
Another critical aspect to consider is the maintenance of the commercial vehicle involved. Proper maintenance is essential to ensure that trucks operate safely on the road. Neglected maintenance, such as worn brakes, faulty steering, or other mechanical failures, can significantly increase the risk of accidents. If a mechanical issue contributed to this wreck, the company responsible for the truck could be held accountable for failing to keep the vehicle in a safe operating condition.
Additionally, if the truck was a commercial vehicle, the company that owns and operates it could share in the responsibility for the accident. If the company failed to enforce proper safety protocols, didn’t adequately train the driver, or didn’t maintain the vehicle properly, they could be held accountable for their role in the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
