Commentary by Attorney Michael Grossman
When I read about incidents like this one, what stands out to me isn’t just what happened, but what’s missing from the conversation. Most people see a crash report, note the time and place and focus on the suspected drunk driver, but very few stop to ask how that driver ended up in a position to cause harm in the first place. If alcohol was a factor, then it's worth looking at whether someone else played a role earlier in the night.
One of the most important but often overlooked questions in cases like this is, “Where did the driver get their alcohol?” Under Texas law, if a bar, restaurant or other alcohol provider overserved someone who was clearly intoxicated, they may share legal responsibility for what happened next. That’s what dram shop law is designed to address: not just punishing the driver, but holding accountable those who contributed to the risk by ignoring obvious warning signs.
That matters because accountability isn't just about criminal charges or insurance. It’s also about making sure injured people like the victim here have the opportunity to ask deeper questions and get real answers. If a business put profit over safety, the law gives victims the right to challenge that.
Accountability, in situations like this, can be broader than it seems. It’s not always obvious, but there may be more to this story than people realize.
Key Takeaways:
- Dram shop law in Texas allows injured people to hold alcohol providers accountable if they overserved a visibly intoxicated person.
- A full investigation should explore not just the driver's actions, but whether a business contributed by serving alcohol irresponsibly.
- Many people don’t realize that legal remedies exist beyond criminal prosecution, until they ask the right questions.
