Commentary by Attorney Michael Grossman
When authorities mention that someone “had been drinking,” it naturally raises the question of whether alcohol contributed to the crash. But even if intoxication is eventually confirmed, that alone wouldn’t make this case open-and-shut. In serious accidents like this one, the focus can’t stop with just who was behind the wheel—it also has to include how that driver got there in that condition.
For example, if the driver had recently been drinking at a bar, restaurant, or similar establishment, there’s a possibility that over-service played a role. That kind of detail is easy to miss unless investigators specifically look for it. Yet under Texas dram shop law, alcohol providers can be held accountable if they serve someone who’s already clearly intoxicated and that person then causes harm due to that intoxication. It’s not always easy to prove, and it’s not always relevant—but when it is, it’s a critical piece of the accountability puzzle.
This isn’t about shifting blame—it’s about making sure no part of the chain of events goes unexamined. Overservice doesn’t excuse an alleged drunk driver's actions, but it can be a contributing factor that deserves attention. If it played a role here, ignoring it would mean overlooking a key opportunity to make Texas roads safer.
Key Takeaways:
- If alcohol played a role, it’s worth asking whether an alcohol provider contributed by serving someone who was clearly intoxicated.
- Dram shop investigations require early, deliberate effort—these details aren’t automatically uncovered.
- Accountability shouldn’t stop with the driver if others along the way also played a part in allowing the crash to happen.
