Commentary
When a driver is suspected of being under the influence in a crash like this, it raises an important question: Where did they get their alcohol, and was it served responsibly?
Police have already filed intoxication assault charges against the driver, which suggests they believe alcohol played a role. But more often than not, the investigation stops there. What’s frequently overlooked is whether a bar or restaurant served the driver while they were already obviously intoxicated.
Under Texas dram shop law, alcohol providers can be held accountable if they break the law by overserving an intoxicated patron who then causes harm. If alcohol did play a role in this wreck, it’s critical to investigate where the driver had been drinking and whether the provider followed the law.
Getting those answers isn’t just about accountability: it’s about making sure alcohol providers take their responsibility seriously to help prevent more crashes like this in the future.
