Commentary by Attorney Michael Grossman
When a driver runs off the road and doesn’t survive, the initial explanation often stops at “the vehicle left the roadway.” But that phrasing doesn’t really answer the most important question—why did it happen?
Did the investigation go beyond the basics?
Not every responding agency has the tools, time, or training to fully analyze a single-vehicle crash. A complete review should include documenting skid or yaw marks, mapping the roadway, and analyzing how the Fusion struck the tree. Without those steps, critical clues about whether the loss of control was sudden, gradual, or influenced by another factor can be overlooked.
Could a vehicle defect have played a role?
Mechanical failures like steering or brake malfunctions, tire blowouts, or stability system errors can cause a car to veer off-road without warning. Beyond what triggered the crash, safety system failures—such as faulty airbags or seatbelts—can determine whether a driver survives. A timely inspection of the Ford is the only way to confirm or rule out these possibilities.
Has the electronic data been secured?
The Fusion’s Engine Control Module (ECM) may hold key data about speed, throttle, braking, and steering inputs just before the crash. Paired with cellphone records or possible nearby camera footage, that data could provide a much clearer account of what really happened. This kind of evidence is highly time-sensitive and must be preserved quickly.
A single-vehicle crash doesn’t mean a simple explanation. The difference between speculation and real answers is whether investigators gather all the evidence before it disappears. If authorities don't take the time to do that, it may be up to independent investigators to pick up the slack.
Takeaways:
- Careful reconstruction is needed to explain why the vehicle left the road.
- Vehicle and safety system defects can both cause and worsen a crash.
- ECM data, cameras, and cellphone records are critical for building a full picture.
