Commentary by Attorney Michael Grossman
People tend to think that accidents involving a single vehicle are going to be simple due to the small scale of the crash. In reality, there can be unique challenges due to the fact authorities sometimes treat these crashes as a low priority. That can lead to shallow investigations that let crucial details slip through the cracks.
For example, I had a case not long ago where authorities were too hasty in their efforts, and they missed a vehicle defect. The victim in that crash had been wearing their seatbelt, but they were still thrown from their seat and suffered serious injuries. It took us having an independent specialist examine the vehicle to find that the seatbelt was defective, and the victim likely would have been fine had it functioned properly.
I'm not saying anything like that happened here, but investigations into defects can be a canary in the coal mine. If authorities haven't inspected the vehicle closely, it raises questions about what else they may have overlooked.
