Commentary by Attorney Michael Grossman
When a driver leaves the roadway and there’s no clear reason why, it's a sign that deeper questions need to be asked. One-car crashes often get written off as driver error, but that assumption can leave important factors unexplored.
1. Did the authorities thoroughly investigate the crash?
Losing control without obvious cause demands a closer look. Investigators should be mapping the vehicle’s path, analyzing any signs of sudden movement or avoidance, and reviewing the driver’s actions before the incident. It matters whether the team on scene had the training and tools to go beyond a basic report. In single-vehicle crashes, the details can be subtle, and missing them can lead to incomplete conclusions.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical issues are often overlooked in solo crashes. A blown tire, failed suspension, or steering problem could cause the driver to veer off the road with little warning. Without inspecting the vehicle’s systems—especially components that don’t always show visible damage—there’s no way to say for certain that the vehicle didn’t play a role. With no other vehicles involved, the car itself should be one of the first things scrutinized.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles like the Jetta often store critical pre-crash data—braking, speed, steering input, and more. If the vehicle was equipped with a GPS or if the driver had a phone active, that data could show signs of erratic behavior or attempted corrections. This digital evidence is especially valuable when there are no witnesses and limited external factors to work with. If it wasn’t preserved early, that information may already be lost.
In any one-car crash with fatal results, the real answers come not from assumptions, but from looking under the surface. There’s often more to the story than what first appears.
Takeaways:
- Single-vehicle crashes should never be assumed to be driver error without full analysis.
- A mechanical inspection is essential to rule out problems with tires, steering, or brakes.
- Vehicle and device data can provide the clearest picture of what led up to the crash.
