Commentary by Attorney Michael Grossman
When a Jeep strikes the rear-end of an 18-wheeler and the driver loses their life, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.
Why didn’t the Jeep stop in time? Rear-end collisions often raise questions about distraction, fatigue, or speed, particularly in the early morning hours when drivers may be drowsy or visibility may be limited. Investigators should examine cell phone records, black box data (if available), and skid marks to determine whether the driver had time to react—or whether the crash was unavoidable due to lack of warning.
Was the 18-wheeler visible and properly marked? Federal regulations require commercial trucks to be equipped with functioning tail lights and reflective markings to prevent exactly this kind of crash. Investigators should verify whether the rear-end of the trailer was clearly visible and whether the lighting and reflective surfaces met safety standards. If those features were missing or damaged, it could have contributed to the crash.
Was the truck being used for commercial purposes? If so, that brings additional safety responsibilities into play. Investigators should determine whether the vehicle was properly maintained, whether the driver was alert and within their hours-of-service limits, and whether the company’s policies contributed to risky or unsafe driving behavior. Reviewing maintenance records, inspection reports, and driver logs can provide important insight.
Did the truck stop suddenly or slow unexpectedly? While the vehicle that rear-ends another is often assumed to be at fault, it's important to know whether the truck was operating normally. If it braked abruptly or came to a stop for unclear reasons, investigators will need to determine whether the truck’s actions were necessary and safe under the circumstances.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
