Commentary by Attorney Michael Grossman
When a vehicle first strikes a guardrail and then collides with another, the sequence suggests more than a simple lane departure. The real question is what caused the driver to lose control in the first place, and whether investigators are pursuing all possible explanations.
Did the authorities thoroughly investigate the crash?
For a crash like this, documenting the scene in detail is essential. Investigators should measure the SUV’s path, determine the exact point of guardrail impact, and analyze how it crossed into the other vehicle. Tire marks, debris spread, and the angle of collision all provide clues about whether the loss of control was sudden or developed over several seconds. A full reconstruction helps bring clarity that basic reporting often cannot.
Has anyone looked into the possibility that a vehicle defect caused the crash?
Mechanical problems—such as steering lock, brake failure, or a tire blowout—can cause a driver to veer into a guardrail without warning. In some cases, stability systems or suspension issues can worsen the situation, particularly at highway speeds. Unless the SUV is thoroughly inspected, the possibility of a defect contributing to the loss of control remains unanswered.
Has all the electronic data relating to the crash been collected?
Modern vehicles record key data just before impact, including speed, braking, and steering inputs. Retrieving that information from the SUV could confirm whether the driver attempted to correct course or experienced a sudden mechanical problem. Traffic cameras or nearby surveillance systems may also hold valuable evidence that should be secured promptly.
Getting to the truth requires more than noting that a driver lost control—it means combining the scene evidence, mechanical findings, and digital records to ensure no potential cause is overlooked.
Takeaways:
- Thorough scene mapping can reveal whether loss of control was sudden or gradual.
- Mechanical inspections are needed to rule out steering, brake, or tire failures.
- Event data and camera footage can confirm driver actions and vehicle behavior before impact.
