Commentary by Attorney Michael Grossman
When I read about accidents like the one involving a FedEx truck on I-270, my first thought is always about the injured person and whether they and their loved ones will have all their questions answered about how the crash happened. While this investigation is still underway, my experience tells me that even in cases that seem straightforward, critical questions often go unanswered unless specific steps are taken. To that end, there are three key questions that need to be addressed in this case.
The first question is whether authorities will thoroughly investigate the crash. Official crash investigations vary widely depending on the training, resources, and time available to the responding officers. While the scene described—a burning vehicle and a critically injured driver—may demand immediate action to preserve life and clear the roadway, these urgent priorities can sometimes lead to missed opportunities for gathering evidence. For instance, documenting skid marks, analyzing the crash scene geometry, and speaking with potential witnesses can provide essential information for reconstructing what happened. If these steps are not taken, critical details about why the truck crossed the median and caught fire could be lost.
The second question is whether anyone will investigate the possibility of a vehicle defect. Mechanical failures, such as brake issues, steering malfunctions, or fuel system defects, can play a significant role in truck accidents. Fires in large vehicles, especially trucks carrying heavy loads, are not as rare as one might think and could be linked to design or manufacturing flaws. To rule out—or confirm—this possibility, it’s essential to preserve the truck for a detailed forensic examination. Unfortunately, in many cases, vehicles are quickly disposed of or repaired, making it impossible to determine whether a defect played a role in the crash.
The third question concerns the collection of electronic data from the vehicle. Modern trucks are equipped with sophisticated systems like engine control modules (ECMs), which can provide critical information such as speed, braking activity, and engine performance leading up to the crash. Additionally, the FedEx truck might have been equipped with GPS tracking or dash cameras that could shed light on the events leading to the accident. Gathering and preserving this data quickly is crucial, as it can be overwritten, damaged, or lost entirely if not secured promptly.
At the end of the day, determining the cause of this crash is essential—not just for the driver who suffered critical injuries but for the community as a whole. A thorough investigation could reveal lessons that prevent similar incidents in the future. The very least we owe to those affected is a commitment to finding answers to the questions that this crash raises.
