Commentary by Attorney Michael Grossman
People often write off car accidents as simple just because of how common they are. However, not only do pretty much all serious accidents involve unique challenges, but also this particular accident may involve significant hurdles that require a lot of experience and tools to overcome. The efforts of authorities alone may not be good enough.
For example, was the victim working at the time? Did this involve an employer who failed to provide the victim with proper working equipment or training? With two other drivers being involved, what led to that initial collision? Have authorities gone through the courts to obtain those drivers' cell phone records? Did they take custody of those vehicle to analyze their Engine Control Module data, which could include speeds, braking, and steering inputs? Were there nearby traffic cameras or businesses with security systems that captured the incident on video?
These are just a few of the angles a proper accident investigation should be able to look at. Frankly, I've learned throughout my more than thirty year career that authorities tend to overlook a lot of these things. Their priorities tend to be clearing the crash scene and looking for potential charges to file. If their efforts don't dig beyond the surface, important details may slip through the cracks. Simply put, a victim's loved ones deserve answers, and a shallow, hasty crash report isn't likely to be enough to get them those answers. Perhaps authorities here have been more thorough than usual, but that's not something I'd take for granted.
