Commentary by Attorney Michael Grossman
People tend to see pedestrian accidents on an interstate and assume everything is open-and-shut. Sometimes, it is, but there needs to be consideration for complex or unusual possible factors. What was lighting like at the time? Were there issues with this construction area that created unnecessarily hazardous conditions? Were other drivers able to see and avoid the victim? Likely or not, things may not be as simple as a pedestrian being in the wrong place at the wrong time. Maybe authorities have taken steps to consider these possible factors, but it sometimes takes more thorough independent investigations to make sure nothing is being overlooked.
