Commentary by Attorney Michael Grossman
Any crash involving a commercial truck is going to present unique challenges. One factor I always consider, for example, is how the truck held up in the crash.
I rarely see authorities inspect commercial trucks to ensure they lived up to modern safety standards, and that factor can play a significant role in deadly truck wrecks. Some manufacturers simply don't care about the structural integrity of their vehicles, meaning truckers might as well be sitting in a tissue box. The cabin fails to hold up under accident conditions other trucks can withstand, and drivers end up seriously injured or killed when they should have been protected.
I'm not suggesting that happened here, but when I see a crash like this come across my desk, and authorities never bothered inspecting the truck for potential defects, it makes me wonder what else they may have overlooked. So with the victim in this crash not able to tell their own side of the story, it's important to follow up with authorities and find out what factors they're looking into. If they're leaving too much up to question, the crash may need to be handled by more thorough independent investigators.
