Commentary by Attorney Michael Grossman
When a single-vehicle crash occurs in the early morning hours, particularly one that results in serious injuries, there’s a tendency to assume the driver made a mistake—perhaps they were fatigued, distracted, or driving too fast. But time and again, I’ve seen that serious crashes are rarely the result of a single factor. To fully understand what happened and ensure that those affected get the answers they deserve, there are three critical questions that should be asked.
First, did the authorities conduct a thorough investigation? Crashes that happen around 2:40 a.m., like this one on Jim Miller Road, present specific challenges—low visibility, limited traffic, and often few witnesses. A complete investigation should include accident reconstruction, an assessment of roadway conditions, and a close look at vehicle dynamics. But the unfortunate reality is that many departments don’t have the training, equipment, or time to perform this level of analysis, particularly for single-vehicle incidents. That’s why it’s often necessary for an independent investigator to step in and make sure nothing important has been overlooked.
Second, has anyone considered whether a vehicle defect might have played a role in the crash? When a car like a Dodge Charger suddenly veers off course and hits a median, it raises questions about whether all of the vehicle’s systems were functioning properly. A failure in the steering, suspension, or braking systems could just as easily have caused the vehicle to lose control. These types of defects won’t be apparent from a visual inspection alone—they require a detailed forensic review. And that’s only possible if the vehicle is preserved before it’s repaired or discarded.
Lastly, has all the relevant electronic data been collected? Modern vehicles are often equipped with event data recorders that capture information like speed, brake application, and steering inputs in the moments leading up to a crash. This data can provide critical context that helps confirm or challenge initial assumptions about the crash. In addition, phone records and nearby surveillance footage may also play a role in establishing what occurred. However, this kind of data is perishable. If steps aren’t taken early to preserve it, it may be lost forever.
In serious accidents like this one, where the cause is still unclear and someone has been badly hurt, it’s not enough to accept easy explanations. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
